Now Tesla is fighting against the frozen funds

In an unexpected turn of events, Tesla has threatened to sue Transport Canada for freezing $43 million of federal EV incentive funds after it had drained most of the fund in a single weekend.

On March 28, a letter was sent to Transport Canada expressing surprise at the government’s decision to freeze the funds and stating that Tesla had complied with government regulations and expected funding to resume. This letter was reported by the Toronto Star.

In a previous report, Tesla claimed it was backfilling order from cars previously sold and was allowed to do so even though the language on the government website claimed otherwise. Tesla’s letter stated that Transport Canada had allowed the practice in a webinar held in 2023 and it was sent out to all participating automakers throughout Canada.

It could be true, because shortly after Toronto Star published the news that Tesla received the majority of federal funding, the website of the government changed the wording to allow backdating. The Star () called out this change and it was reverted to its original form, which does not allow backdating. Tesla claims that the funds were frozen under “caretaker rules” which states that Prime Minister Carney is in an election period and the government must act with restraint. The rebates cannot be frozen during this time.
