Yesterday’s ruling overlooks the significant competitive edge Google possesses in the generative AI sector, stemming from its dominant position in the search engine market. This decision effectively allows Google to extend its search monopoly into the AI domain unchecked. Alarmingly, the court portrays generative AI as a straightforward remedy for search market competition without critically analyzing how Google’s control over search underpins its influence across the entire AI technology stack-raising the risk of repeating past monopolistic patterns.
Contrary to Judge Mehta’s suggestion that the future is uncertain, the trajectory is clear: Google will leverage its search monopoly to maintain and expand its dominance in generative AI. This includes harnessing trillions of live search queries to refine its AI models, utilizing its vast ecosystem of consumer products to integrate and promote AI technologies, and deploying billions in revenue to fund ambitious and high-risk AI ventures.
