In a significant move, Sweden’s Data Protection Authority (IMY) has halted the use of an artificial intelligence (AI) system employed by the Swedish Social Insurance Agency (Försäkringskassan) to identify potential welfare fraud. This decision follows extensive scrutiny by media outlets, regulatory bodies, and human rights organizations, which uncovered troubling patterns of discrimination embedded within the AI model.

Since 2013, Försäkringskassan has utilized a machine learning algorithm designed to assign risk scores to benefit applicants, triggering investigations when scores exceed certain thresholds. Revelations of Discriminatory Bias

Investigations published in late 2024 by Lighthouse Reports and Svenska Dagbladet revealed that the AI disproportionately flagged women, individuals with immigrant backgrounds, low-income earners, and those lacking higher education credentials. Conversely, the system failed to effectively identify fraud among men and wealthier applicants, raising concerns about systemic bias.

Amnesty International condemned the AI tool as “dehumanizing” and likened its operation to modern-day witch hunts, urging immediate discontinuation. These findings spotlight the risks of embedding biased data and flawed assumptions into automated decision-making systems that impact vulnerable populations.

Regulatory Response and System Suspension

Following these revelations, IMY launched an official inquiry into the AI system’s compliance with data protection laws and ethical standards. During the investigation, Försäkringskassan voluntarily withdrew the AI tool from active use. IMY’s legal representative, Mans Lysen, confirmed that with the system offline and associated risks mitigated, the case was closed.

Försäkringskassan has stated it does not intend to reinstate the current risk profiling model, opting instead to rely on employer-reported absence data, which they believe offers more accurate fraud detection without the ethical pitfalls of AI profiling.

Alignment with European AI Regulations

The suspension aligns with the European Union’s AI Act, effective from August 2024, which mandates rigorous risk assessments and safeguards for AI systems used by public authorities, especially those influencing access to social services. The legislation explicitly prohibits AI applications that function as social scoring mechanisms, reflecting growing concerns about fairness and transparency.

A spokesperson for Försäkringskassan emphasized their commitment to compliance, stating, “We paused the risk assessment profile to evaluate its conformity with the new EU AI regulations and currently do not plan to reactivate it.”

While critics have called for greater openness regarding the AI system’s inner workings, Försäkringskassan has resisted full disclosure, citing concerns that revealing operational details could enable individuals to circumvent fraud detection measures.

In the United Kingdom, an internal review by the Department for Work and Pensions (DWP) uncovered significant disparities in a machine learning system used to screen Universal Credit claims. The system exhibited bias across protected characteristics such as age, disability, and marital status, prompting civil rights groups to demand greater transparency and accountability.

Organizations including Amnesty International and Big Brother Watch have highlighted how AI can amplify existing inequalities within social security frameworks, underscoring the urgent need for ethical AI governance.
